Below, we describe the ins and outs of tree law as well as the wisdom we can take from these cases:

How Is Tree Law Practiced?

Although its focus may seem narrow and its exercise quaint, tree law is a complex and constantly evolving field. Indeed, its practice is influenced by common law and statutory law, which makes it subject to past rulings and current legislation. Nevertheless, we can divide it into two categories:

  • Public tree law regulates trees on public property, such as streets, parks, and forests. State and local governments usually enact this body of law.

  • Private tree law treats the rights and responsibilities of landowners concerning the trees on their property.

Although applied to different parties, both branches may treat the same issues. For instance, what person or entity owns a tree located on a property line, what party is responsible for tree maintenance on a property line, who can remove a tree and under what circumstances, and who is liable for damage caused by a falling tree. Tree law can also shield trees from removal, as when a city government requires a felling permit.

When You Might Need a Tree Lawyer

Is a neighbor’s tree blocking your view of the landscape? Are you concerned nearby property development will harm your neighborhood’s trees? Hiring a lawyer could help with these issues and many more, including:

  • Ownership disputes: Determining who a tree belongs to when it grows on a shared property line between you and a neighbor.

  • Maintenance disputes: Arbitrating that a neighbor must provide maintenance on a tree encroaching on or causing damage to your property. If you cannot resolve the dispute amicably, a tree lawyer can also represent you in court.

  • Removal disputes: Arguing that you can remove a tree on your property even though your neighbor or municipality objects. A lawyer can help you navigate the legalities around tree removal.

  • Filing damages claims: Following one of your trees falling and damaging your or someone else’s belongings.

  • Filing for protection ordinances: Protecting nearby trees when you believe your community or another individual plans to remove them.

How Tree Services Can Help You with Litigationnatural resource management Bluemont VA

Tree law can affect your property and community’s natural resource planning and management. So, while you may not find tree law an interesting discussion topic for its own sake, consider how professional tree services can affect tree litigation. For example:

  • Assessing damage: A tree service can inspect the damage caused to your trees or property by another party, which may involve gathering photographic evidence and detailed notes. Doing so can help build a strong case in court.

  • Assisting with court orders: If you succeed in a lawsuit for damage to your trees, the court may order the defendant to plant new trees or repair damaged property. A tree service can help them comply and ensure the work is done correctly.

  • Correcting previous services: If an unethical or unscrupulous tree service damages your trees while working on your property, you could sue the company for negligence. As a certified professional provider, Timber Works can assess the damage and the cost of repairs and then assist with those repairs.

  • Providing maintenance: To avoid legal disputes about the trees on your property, hire professional arborists for trimming and pruning services. Doing so helps support your trees’ health and prevent branches or trunks from falling onto a neighbor’s house or belongings. Furthermore, their expertise can help you identify diseased or infested trees through tree inspection and structural evaluation.

Timber Works recently removed a tree that was threatening the foundation of one of our buildings. This was my first experience with Timber Works, and it will not be the last. Their people were amazing. They, were friendly, they were courteous, they patiently explained every step and left the whole area incredibly clean. If they could get 10 stars, they would easily deserve them. I recommend them without reservation - they are the best!

I have used Timber Works twice for tree removal/trimming. They are prompt, professional, fairly priced, kind, and hard working. They were great sports (both times!) about having an audience of interested children, and were so nice to them— even to the point of asking them how long they wanted the cut branches, because my boys requested fort building material😊. I recommend Timber Works to anyone looking for tree removal/trimming/information, and will continue to!
Response from the owner:Thank you, Elizabeth for the review, but also the business! We are so glad that your kiddos were able to benefit from the work done at your property as well. We look forward to working with you in the future and appreciate your recommendation!

Multiple very large trees that needed removal to avoid hitting my house and neighboring house. Trees were not easy to access given location of patio that I wanted protected. Obtained multiple quotes for both price and approach to the job. Timber Works won on both criteria. Crew was great to work with. Four trees down with all trunks, limbs, and debris removed same day. They had all the right equipment for this job. The crew members were skilled and respectful. Highly recommend them.
Response from the owner:Thank you, John, for the kind review and business! It was our pleasure serving you and we hope to do so in the future!
